History of Jurisprudence
The leaders (Allah peace be upon them),they were responsible for the experssion of the divine laws,and also it will be shared with the disciples , mans like : Zorare,Mohaammad ebne moslem, Aboobasir & Aban ebne taghlab , they put lawful,unlawful and jurisprudences to people.the leaders( Allah peace be upon them) were referred people to them.
said Shoaib arghanooni :I asked from Imam Sadegh( Allah peace be upon him) , how is when ask about what we need ,now who to ask ? he said : I"ll refer you to Asadi ,it means that Aboobasir.
and also Abdollah abi yaafoor say :I tell to imam Sadegh (Allah peace be upon him)every time that its not may for me to see you and also often aman of SHias come and ask something from me and idon"t know about all of his questions, now what is my job ?
he said : why don,t you refer to Mohammadebne moslem,ask him ever knowing because he learned things from my father and he was esteemed and respected for my father.
and also Ali ebne mosayyeb hamedani say : I tell to Imam Reza(Aph),i’me living in a far area and i don’t have refer you at every time so whose take my religion programs? he said : from zakaria ebn adame ghomi that he trusted in the church and the world. Ali ebne mosayyeb said that : when i returned to my hometown asked my questions from Zakaria ebne adam.
and also Abdolazizebnelmohtadi say :
I asked from Imam Reza (Aph) : at every time i can,t see you so what should i do for my religion provision questions? he said: from yoonesebne abdrrahman .
The leaders (Aph) often ordered to their disciples that tell provision to people and tell definitive verdict because i love that be seen like you in my SHiahs.
Imames ages gradually passed and the absent ages for Imam Mahdi(Aph) come and expressiones about lawful&unlawful were assigned to Faghih and definitive verdict topic and imitation topic overall prevalence was particulary .
SHahid ayatoAllah Motahhari say : we start history of SHia jurists from short absent time ,it has two reasons :
1- The ages before short absent was the age of Imamse presence.although the priets was that Imames ovationed them , but like it or not priets because of presence Imamse they was overwhelmed .
2- Appearence our collected jursproudence ended to the short Absent , it means that we don,t have any compilation before that time .
